It doesn't bother me. Exceptional people don't have to be exceptional in school.

I think you're trying to say they found the right in a "penumbra" (essentially the "shadow cast by") of Substantive Due Process. Other such fundamental rights are the right to marry, to raise your children, and to have private consensual homosexual intercourse.
That's right when looking at the holding, but my fear is it's precedential value when the Supreme Court decides it has jurisdiction to even hear a case. (there is a word for that, but I took Con Law 6 years ago, so you have to help me)
I took Con Law 2 & 3 years ago, but I took the VA Bar like a month ago (still got 1.5 months before the results come back). The court could use it as precedent to say it has standing to hear another such case, but I don't think the Court would do so. While at law school, we had the honor of having both Justice O'Connor and Justice Ginsburg speak. Both of them strongly felt that Bush v Gore would not have any precedential weight going forward, so that's good enough for me.

But I agree that it could happen, and that I hope it doesn't happen.

Jim, you've made your point. She is not as educated as the rest of them.

To answer your question, where someone went to school, or what their major was, doesn't mean [expletive] to me. I've met plenty of lawyers from the "big" law schools who are terrible at their job.

LOL...like I said Con Law was a long time ago. But, the right to marry, to raise your children, and to have private consensual homosexual intercourse are not fundamental rights. Just ask Scalia and Thomas.

Wow...NBC had a "mistake" when replaying the President's speech and made him look like an idiot with long pauses when there should have been applause.
