Is that true? In Driver's Ed, I was told that when you get a driver's license you are giving "implied consent" to take the brethalyer test, and that the penalty for violating the implied consent was more severe than the penalty for DUI.

FWIW, there's a lawyer here in town that runs ads on ESPN radio all the time saying the same thing. Don't take the field test, because it's voluntary. The only test required is the certified test, which you take after getting back to the station.

I'm sure the cops will give you a hard time about it, and try to talk you into the field test, but I've always heard this is true. Of course, that could vary depending on states and .jurisdictions

But everyone should make note that he did apparently take some form of prescription medicine "at the end of the night". Which could have had an adverse affect with the alcohol, and might have led to how poorly he fared on the sobriety tests.

Or he was pretty drunk.

Messing up the alphabet, not being able to stand on one leg for more than 4 seconds and not being able to walk a straight line all at a .093?

FWIW, I think it's a bit tacky for a lawyer to go on air handing out advice for how to wiggle out of DUI convictions. People shouldn't be trying to skirt the system.

But if we are handing out advice, I also recommend that if you do take a breathilizer, always request to rinse out your mouth with water before taking the test. On my friend's breathilizer, that can affect the readings up to 0.20.

Agree 100%. My buddy had one also and if you took a drink and blew into the thing (even if it was your first drink), you would blow off the charts.
