You don't want him to be accountable for making a decision that cost a man his life, though.
If a guy gets drunk and says "shoot me in the head!", and you do it, it's still murder. Bad decision by the guy who got shot, but that doesn't change the fact that it's murder.
If Brent had just gotten a DUi, he probably wouldn't have spent any time in jail. If he is convicted, and I think this is his 2nd DUI, he probably would get a couple days. I'm not sure, but I'd guess that to be correct. All I'm saying is he ought to be punished to the max for that DUI, maybe a year or two or three or five...whatever the max is (which is more accountability or punishment or whatever than a simple DUI charge would bring or to spell it out further I am not in any way saying he shouldn't be held accountable for Browns death....). Now, if he had killed a little girl riding her bike on the sidewalk, I'd say you should throw the book at him. Vehicular homicie/involuntary manslaughter/whatever. Go to jail for 20 years or whatever. I don't care. That's not what I'm talking about.
If you believe jail serves a purpose to prevent people from committing crimes by scaring them, you're not in any way lessening the penalty or the fear factor of drunk drivers killing innocent people. If you also think jail is there to punish those that have done something wrong, well, what's worse: killing your best friend or spending 5-10-20 years in jail? I'd spend 20 years in jail in a heartbeat to bring back loved ones.
Brents life is basically over. I doubt he comes back to the NFL after this and who knows what he'll do afterwards. He killed his friend. He's going to jail (the only question is how long). I guess I just don't feel he needs to spend 30 years in there to really atone for what happened. (Well, ignoring the details of him leaving his friend in there...that's a whole other side of the story.)
I mean, does it matter if he is in there for 3 years or 30? What's the difference? Is 27 years in jail suddenly going to make up for Brown's death? Does Brown's family want that? I don't nkow. I guess if they do, they should go after that, but I don't get the feeling that is the right answer.
I've been a passenger when I knew the driver was intoxicated. If I died because we wrecked, I certainly wouldn't want a friend whom I trusted despite knowing he was drunk to face any more hardship over my death than the guilt he would feel. And, I guess that's where I'm coming from.
1st offense: DWI manslaughter – Killing another person while drunk driving is a second-degree felony, punishable by 2 to 20 years in a state prison and/or a fine of not more than $10,000.
