A customer just told me that they hated their lunch, which I thought was strange considering the fact that they ate all of it. It turns out that they were just making a hilarious joke and they really liked it.

The bastards at Flemings only honored $75 of my in-laws $100 gift certificate they received this past Xmas.

Why did they do that?

Doesn't make sense to me to piss someone off over $25.00

If it was donated and expired they were doing them a favor by honoring it at all and if it was actually paid for then that isn't legal.

my brother&sister-in law from Chicago area gave it to them for Xmas. There may be some loophole, but my brother-in-law was pretty pissed to find out about this. I'll figure out what happened.

Apparently there is an inactivity fee that can be issued after a year. I'm shocked they'd do that. If that's the case, he definitely should be pissed.

Was told they bought it at Flemings, this past xmas.

I am getting this 2nd hand, but seems to jibe -last minute gift, not far from where they were staying, and couldnt see my inlawa sitting on that for more than a year.

On May 22, 2009, the Credit Card Accountability Responsibility and Disclosure Act of 2009 (Credit CARD Act)1 was signed into law. While the law’s title suggests that it only applies to credit cards, the law also created new consumer protections for gift certificates, store gift cards, and general-use prepaid cards through amendments to the Electronic Fund Transfer Act (EFTA).2 Specifically, section 401 of the Credit CARD Act requires disclosures for gift certificates, store gift cards, or general-use prepaid cards fees and expiration dates; limits dormancy, inactivity, and service fees for these cards and certificates; and establishes a minimum period of five years before the underlying funds for these cards and certificates can expire.

In that case I would call their corporate office. My roommate used to manage Fleming's in Frontenac and says he doesn't have a clue why they wouldn't redeem it and it's illegal etc.

My guess is that they were gifted a bonus/promotional/reward (maybe discounted) card that's not backed by money and is excluded from the protection of the EFTA. The underlying funds are what's protected, so some certificates can be fully or partially exempt. If that's the case, it has to be clearly stated, so in a way it's both a [expletive] gift and user error - but even then I'm still surprised they wouldn't honor it. Most places never say no even if they can.
